Warranty terms

Every system Delta Temp Climate Solutions ("Delta Temp", "we", "our" or "us") installs comes with two separate warranties: the manufacturer warranty on the equipment, and our own workmanship warranty on the installation work we carry out. These terms explain what each one covers, what is not covered and how to make a claim. They form part of every proposal, quote and agreement that refers to them.

1. Our workmanship warranty

1.1 Delta Temp warrants that the installation work we carry out will be free from defects in workmanship for 10 years from the date the installation is completed, or for the period stated in your proposal, quote or invoice if that is different.

1.2 A defect in workmanship is a fault caused by the way Delta Temp carried out the installation. Examples include a refrigerant leak at a joint or flare we made, a condensate drain we installed that was not run or fixed correctly, ductwork or an outlet we installed that was not connected or supported correctly, an electrical connection or circuit we installed that is faulty, and a bracket, stand or fixing we installed that fails.

1.3 If we confirm a defect in workmanship, we will repair or redo the affected work, at our choice, at no charge for the labour and materials needed to fix it.

1.4 A repair under this warranty does not extend or restart the warranty period.

1.5 The warranty applies to the installation at the property where it was carried out. It passes to a later owner of that property for the rest of the warranty period.

2. What the workmanship warranty does not cover

The workmanship warranty covers our installation work only. It does not cover:

  • Faults in the equipment itself, including indoor and outdoor units, compressors, fans, motors, circuit boards, sensors, controllers, zone motors, remotes, wifi modules, solar panels, inverters and batteries. These are covered by the manufacturer warranty (section 3).
  • Fair wear and tear, and the normal ageing and deterioration of the system and its parts over time.
  • Servicing and maintenance, and faults caused by a lack of it, including dirty filters and coils, and drains or outlets blocked by dust, mould, debris, insects or vermin.
  • Damage from outside causes, including storms, flooding, lightning, power surges and supply faults, fire, salt air and environmental corrosion, vermin or pests, accidents, misuse, and movement of the building.
  • Work by others, including any alteration, relocation, repair or service by anyone other than Delta Temp, and damage to our work caused by later trades, renovations or roof work.
  • Existing or client supplied items we connected to or reused at your request, such as existing ductwork, pipework, wiring, switchboards, or equipment supplied by you or a builder.
  • The building and its existing services, including the structure, roof, ceilings and the existing electrical installation, and conditions that existed before we started.
  • Comfort or performance differences where the system was installed to the agreed design and is working as designed, for example rooms that run warmer because of sun, insulation or how doors and zones are used.
  • Extra access costs that only arise from changes made to the property after the installation, such as scaffolding, elevated work platforms, or removing built in joinery or finishes.

3. The manufacturer warranty

3.1 The equipment is covered by its manufacturer's warranty, on the manufacturer's own terms, which decide what is covered and for how long. For air conditioning this is currently Fujitsu 5 years and Hisense 7 years parts and labour on residential installations. Commercial use, solar panels, inverters, batteries and controls each carry their own manufacturer terms.

3.2 We register the manufacturer warranty for you on the day of installation and help you lodge a claim if a part fails.

4. Conditions

The workmanship warranty applies only when:

  • the installation has been paid for in full;
  • the system has been serviced by a licensed technician at least once every 12 months, or more often if the manufacturer requires it, and you can show records of that servicing;
  • the system has been used and looked after in line with the manufacturer's instructions;
  • you tell us about the problem as soon as reasonably possible after you notice it, and stop using the system if running it could cause further damage; and
  • you give us reasonable access to the property during business hours to inspect and fix it.

5. How to make a claim

5.1 Contact us with your name, the property address, your invoice or job number, a description of the problem and photos if you can:

Delta Temp Climate Solutions
2/11 Abeles Street, Baringa QLD 4551
Phone 1800 335 828
Email [email protected]

5.2 We will arrange a time to inspect the system. If the fault is a defect in our workmanship, we fix it at no cost to you, and we bear the cost of attending. You bear your own costs of making the claim, such as phone calls and photos.

5.3 If the inspection shows the fault is not covered by the workmanship warranty, for example an equipment fault, wear and tear, or a lack of servicing, our standard call out and labour rates apply to the visit. We will tell you before doing any further work that would be charged. If it is an equipment fault, we will help you lodge the claim with the manufacturer.

6. Your rights under the law

6.1 Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us, and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

6.2 The benefits of our workmanship warranty are in addition to your other rights and remedies under the law, including the Australian Consumer Law and the statutory warranties for domestic building work under the Queensland Building and Construction Commission Act 1991. Nothing in these terms excludes, restricts or changes those rights.

6.3 These terms are governed by the laws of Queensland.
