Terms and conditions
These Terms and Conditions of Trade ("Terms") govern the business relationship between Delta Temp Climate Solutions ("Delta Temp", "we", "our" or "us") and our clients ("you" or "your") for air conditioning and climate control products, services and related solutions ("Services"). By engaging with or accepting our Services, you agree to be bound by these Terms.
2. Services
2.1 Delta Temp will provide air conditioning and climate control products, installation, maintenance, repair and related services as agreed with the client.
2.2 The scope of work, including specifications, costs and timelines, will be detailed in a separate written agreement or proposal.
3. Quotations and pricing
3.1 Quotations are valid for the period specified in them or 30 days, whichever is shorter.
3.2 Prices are in Australian dollars and include GST unless stated otherwise.
3.3 Delta Temp may adjust prices due to unforeseen circumstances, changes in scope, or additional work requested by the client.
4. Orders and acceptance
4.1 To initiate an order, the client must provide written acceptance of Delta Temp's quotation or proposal.
4.2 Acceptance constitutes agreement to these Terms.
4.3 Any changes to the scope of work must be agreed in writing by both parties.
5. Payment terms
5.1 Payment terms are as specified in the quotation or proposal.
5.2 Delta Temp may request a deposit or advance payment before commencing work.
5.3 Invoices are due within the stipulated timeframe from the date of invoice.
5.4 Late payments may incur interest at a rate specified by Delta Temp or as permitted by law.
6. Delivery and installation
6.1 Delivery and installation timelines will be agreed with the client.
6.2 Delays caused by unforeseen circumstances, including weather, supplier issues or regulatory approvals, are not the responsibility of Delta Temp.
6.3 The client shall provide suitable access and conditions for installation.
7. Warranties
7.1 Equipment is covered by its manufacturer's warranty, on the manufacturer's terms. Delta Temp registers the manufacturer warranty for you and helps you lodge a claim.
7.2 Delta Temp's workmanship warranty covers defects in the installation work Delta Temp carries out, for the period stated in your proposal, quote or invoice. It does not cover faults in the equipment itself, fair wear and tear, lack of servicing or maintenance, damage from outside causes, or work by others. 7.3 Warranties may be voided if equipment is tampered with, improperly maintained, or used against the manufacturer's instructions.
8. Limitation of liability
8.1 To the extent permitted by law, Delta Temp is not liable for indirect, incidental, consequential or special damages arising from the Services or the use of our products.
8.2 To the extent permitted by law, Delta Temp's liability for any claim, including breach of contract or warranty, is limited to the amount paid for the specific Services.
8.3 Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or the Queensland Building and Construction Commission Act 1991 that cannot lawfully be excluded, restricted or modified.
9. Termination
9.1 Either party may terminate the agreement with written notice if the other party breaches these Terms and fails to rectify the breach within a specified period.
9.2 Termination does not relieve the client of the obligation to pay for work already performed and expenses incurred.
10. Governing law
These Terms are governed by the laws of Queensland, Australia.
11. Cancellation and refunds
11.1 To cancel an order, the client must give written notice. Cancellations within 48 hours of acceptance receive a full refund of any deposit paid. Cancellations after 48 hours may incur a cancellation fee, detailed in the quotation or proposal.
11.2 Delta Temp may cancel any order at any time, in which case it will refund any payments received in full.
11.3 Refunds are processed within 14 days of the cancellation notice, using the original payment method unless otherwise agreed.
By engaging Delta Temp's Services, you acknowledge that you have read, understood and agreed to these Terms and Conditions of Trade.
